Terms & Conditions

Use of the Dropmore Vineyard website is conditioned upon your acceptance of all the terms, conditions, policies and notices of using the site stated here, which may be subject to change from time to time. DVL reserves the right to make changes to these T&Cs immediately by posting the changed T&C in this location.

In these Ts & Cs:

“We”, “Us”, “the Company”, “DVL”mean the company Dropmore Vineyard Limited.
"You", "your", "the Customer" mean any person who places an order for the purchase of products/requests services from Dropmore Vineyard Limited.

You agree to be bound by these Ts & Cs by continuing to access this site and/or by placing an order for the purchase of products from DVL.

ORDERS

It is your responsibility to ensure that all information is accurate and complete for the purposes of placing and delivery of an order. Your use of DVL’s online store will ask for your email address and telephone number for delivery purposes when you order.

Products offered on the DVL website are subject to availability, and if they are subsequently found to be unavailable once an order is placed, you will usually be informed within 3 working days.

As a small producer with limited stock, we cannot guarantee the availability of specific vintages.

In the event that a product is unavailable after an order has been placed, we shall contact you to arrange refund, credit or replacement for the completion of your order.

We are not liable for any compensation for any cancelled, unfilled, incomplete or late order or delivery of order, except as above.

AGE RESTRICTIONS

We may only sell alcohol to persons of legal age to purchase alcohol, in the UK that is aged 18 and over. In placing an order, you warrant that you are of legal age to purchase alcohol and that you are not buying alcohol for someone who is not of legal age to purchase alcohol. We reserve the right to refuse to accept or to cancel an order or to withhold delivery in our sole discretion if we believe that you are not 18 or over or if you are purchasing for a minor (whether or not you are 18 or over).

PRICES & PAYMENT

We must receive payment of the whole of the price for the products that you order and for delivery before your order can be accepted. We accept payment by Credit/Debit card and PayPal. Your credit card details are captured securely. At no time does any person within our company see any details of your credit card. If your payment is reversed, we may cancel your order and repossess any products we have shipped or delivered.

All transactions are secure and encrypted.

We reserve the right to withdraw any promotional offer at any time without previous notice. And the right to adjust prices, offers, goods and specifications of goods at our discretion at any time before (but not after) we accept your order.

While every effort is made to ensure the published price of the products is accurate, we cannot guarantee pricing will be correct in all circumstances or that all products will be available at all times. In the event of a pricing error, we will offer you the option of a completion of the order at the correct price, a replacement or a refund, at your discretion.

The cost of delivery will be as stated on our online store.

DELIVERY

Risk in the products shall pass to you immediately on delivery. We will deliver the products ordered by you to the address you give us for delivery at the time you make your order at the Checkout. It shall be your responsibility to ensure that someone is available to take delivery or that a secure location is specified in the delivery details at which the products may be left. We will not be liable for any loss or damage suffered as a result of the carrying out delivery instructions given by you and the products being subsequently lost or stolen.

Any delivery dates supplied through the online store following acceptance of an order are given in the expectation that we will be able to fulfil them. Notwithstanding the foregoing, the Customer accepts that time is not of the essence and DVL shall be under no liability for loss, damage or expense suffered by the Customer or any third party arising from the failure of DVL to deliver on any specified date or time or place.

Delivery will be made as soon as possible after your order is accepted (usually dispatched within 5-7 working days from the date the order is accepted). Please note that at those times of the year when high volumes of orders are being placed, eg Christmas, Easter etc., we cannot always achieve delivery within the usual timeframe.

CANCELLATIONS & RETURNS

You have a right to cancel your order by notifying us at sales@dropmorevineyard.co.uk within 14 days after the date we accept the order. However, we are only obliged to reimburse the cost of returning items where they were delivered in error, or the products were damaged or defective at the point of delivery. In every other case, you are responsible fo the return to us of any products already delivered to you (and for breakages and loss in transit), which must be returned to us within 14 days of the date of cancellation. We will refund cancelled orders where payment has cleared and all delivered products are returned in re-sellable condition, sealed and in original packaging, within 14 days. Time shall be of the essence and we shall not be obliged to accept any returns made after these dates or process any refunds in respect of such late returns.

You cannot cancel your order if:

the goods have been opened by you or any seals broken; or
the goods have been altered, marked or damaged by you in any way.

Our wines should reach you in undamaged packaging, fit for human consumption and of the stated alcoholic content by volume, and the contents matching the contents on bottle labels. We will provide a full refund or replacement for any wines that do not reach you in that condition, provided that you notify us in writing or by email to sales@dropmorevineyard.co.uk within 3 days of receipt of goods, except in the case of corked wines or wines which are unfit for human consumption in their ordinary shelf life or recommended drinking, in which cases they must be similarly notified to us but within 3 days of opening (and in which cases you must keep the contents for our further instructions).

Your mandatory statutory rights as a consumer (if they apply) are not affected by any limitation in these terms.

We shall have no liability to you for any failure to deliver products you have ordered or any delay in doing so or for any damage or defect to products delivered, except that (a) we shall be liable at our option, to make good the order or to provide you with a refund within 30 days of your notification, as our final liability; and (b) except further that nothing in these terms is intended to nor will it operate to limit or exclude our liability for death or personal injury caused by our negligence.

Please consume alcohol in moderation and be aware that sparkling wines can be volatile due to the build-up of gas: extra care should be taken when uncorking, including angling the bottle away from the face, eyes and other people.

Unless otherwise expressly stated in these Terms and Conditions, all notices from you to us must be in writing, sent to sales@dropmorevineyard.co.uk

Each of the provisions of these Ts & Cs is severable and distinct from the others and if at any time any one or more of such provisions is or becomes invalid, illegal or unenforceable in any respect under any law, the validity, legality and enforceability of the remaining provisions shall not be in any way affected or impaired thereby.

Any variation of these Ts & Cs requested by you shall only be effective if in writing and acknowledged in writing by DVL.

We adhere to the procedures set out in the UK Data Protection Acts 1998 and 2018 and GDPR in the storage and disclosure of any data to prevent unauthorised access. Your information will be used to process orders and for the use of marketing, as set out in our Privacy Policy.

By using this site you are doing so at your own risk.

Your use of any information or materials on this website is entirely at your own risk, for which we are not liable. It shall be your responsibility to ensure that any products, services or information available through this website meet your specific requirements.

The images, digital copies, descriptive matter and specifications of the goods contained on the online store are posted for the sole purpose of giving an approximate idea of the goods and you acknowledge that there may be differences between those and our actual products.

All of the copyright in the products and designs, material, documents, site design, graphics, systems, codes and connections contained on our Website or linked to it and the selection and arrangement thereof are owned by or licensed to us, the Website designers or the publishers of those sites to which this Website links. All rights are reserved. You are entitled to electronically copy and to print in hard copy sections of this Website for the sole purpose of placing an order with us or for viewing our product range and not for any other purpose. Any other use of material on this Website, including photocopying, modifying and/or distributing any pages printed off this Website for the purposes other than those noted above, without our prior written consent, is strictly prohibited.

LAW & JURISDICTION

These Ts & Cs and any order or contract between us shall be governed by and interpreted in accordance with English law. You and DVL submit to the exclusive jurisdiction of the courts of England and Wales as regards any claim, dispute or matter (whether contractual or non-contractual) arising out of or in connection with these Ts & Cs and any agreement relating to the supply of products to you by us.

These Ts & Cs, together with our online store prices, delivery details, contact details and Privacy Policy, set out the whole of our agreement relating to the supply of the products to you by us.
